These Terms form part of the contract for accommodation booked directly with Fanal Holiday Homes. Standard payment terms apply to direct bookings unless a different rate-specific condition is clearly shown before booking. Cancellation conditions depend on the accommodation category booked. Promotional, non-refundable or other special-rate terms may replace the standard cancellation policy where clearly disclosed. Mandatory consumer rights are not affected.

1. About Fanal Holiday Homes and These Terms
These General Booking Terms & Conditions (the "Terms") are issued by Tal-Fanal Village Ltd, trading as Fanal
Holiday Homes ("Fanal", "we", "us" or "our").
These Terms govern accommodation reservations made directly through our website, by telephone, by email or through another direct sales channel. They also govern the use of our accommodation and facilities during a stay unless a third-party booking partner has imposed a specific term that validly applies to the booking.
Where a booking is made through an online travel agency, travel agent, tour operator or other intermediary, the payment, amendment and cancellation conditions displayed by that intermediary may apply. Fanal property rules, safety rules and operational conditions continue to apply during the stay.
If any provision of these Terms conflicts with mandatory law, the mandatory legal provision will prevail and the remaining Terms will continue to apply to the extent permitted by law.

3. Making a Reservation and Formation of the Contract
A reservation is binding once it has been accepted by Fanal and a booking confirmation has been issued, subject to any payment condition stated in that confirmation.
The person making the reservation (the "Lead Guest") confirms that they are authorised to make the booking on behalf of all members of the party and is responsible for ensuring that the party is aware of and complies with these Terms and any property-specific rules.
The Lead Guest must provide accurate contact, occupancy and other information reasonably required to administer the booking. We may request the names, ages or dates of birth of guests where necessary for occupancy control, registration, statutory reporting or calculation of the environmental contribution.
Where the booking confirmation identifies an accommodation type or category rather than a specific unit, Fanal may allocate any unit within the booked category that provides the contracted capacity and principal features.
Requests for a particular unit, floor, view, bed arrangement or other preference are requests only unless expressly confirmed by us in writing as part of the booking.
4. Prices, Payment and Charges
For standard direct bookings, a deposit of 25% of the total accommodation charge is payable at the time of booking, unless a different payment condition is clearly stated before the booking is confirmed. The remaining 75% balance is due 30 days before check-in and will normally be automatically charged to the payment card provided for the reservation.
Where a direct booking is made 30 days or less before check-in, 100% of the total accommodation charge is payable at the time of booking. The 25% deposit is refundable where the reservation is cancelled within the applicable free-cancellation period set out in Section 6, unless a non-refundable or other special-rate condition applies.
If an automatic or scheduled balance payment fails, we may request an alternative payment method. If the
outstanding amount is not paid after reasonable notice, we may cancel the reservation. Failure to complete a
payment does not remove any cancellation charge that has already become due under the applicable cancellation policy.
Where payment is processed by a payment-service provider, bank or booking intermediary, that provider may
process payment information under its own terms and privacy arrangements. Fanal Holiday Homes does not add a separate credit-card or payment-processing fee for standard direct card payments. Any optional service, upgrade or additional charge requested after booking will be charged at the rate communicated and accepted at the time of request.
5. Malta Environmental Contribution
For stays commencing on or after 1 July 2026, the Malta environmental contribution is currently EUR 1.50 per night for each person who is 18 years of age or older at the start of the visit, subject to a maximum of EUR 22.50 per person per visit.
The contribution is a statutory charge and must be charged separately from the accommodation rate and shown as a distinct item on the invoice or fiscal receipt. It is not subject to VAT or commission. We may request age or identification information reasonably necessary to calculate and document the contribution.
If the legally prescribed rate, cap, exemptions or collection rules change, the rate and rules required by law at the time of the stay will apply.
6. Cancellation by the Guest
6.1 Standard cancellation policies
For direct bookings, the standard cancellation schedule depends on the accommodation category booked. The
applicable schedule below forms part of these Terms and should also be shown or communicated before the booking is confirmed.
Farmhouses & Private Pool Properties
• 91 days or more before check-in: 0% cancellation charge. Any accommodation amount paid is refundable.
• 90 to 31 days before check-in: 25% of the total accommodation charge.
• 30 days or less before check-in: 100% of the total accommodation charge.
• No-show: 100% of the total accommodation charge.
Villagg tal-Fanal & Ta’ Frenċ - Shared Pool Properties
• 61 days or more before check-in: 0% cancellation charge. Any accommodation amount paid is refundable.
• 60 to 31 days before check-in: 25% of the total accommodation charge.
• 30 days or less before check-in: 100% of the total accommodation charge.
• No-show: 100% of the total accommodation charge.
A cancellation takes effect when the cancellation request is received by Fanal Holiday Homes at
reservations@fanalholidayhomes.com or, where the booking was made through a third-party booking channel that requires cancellations to be processed through that channel, when the cancellation is validly submitted through that channel. Guests should retain written confirmation of cancellation.
6.2 Special, promotional and non-refundable rates
A promotional, non-refundable, early-booking, group, partner or other special rate may have different payment or cancellation conditions. Where those conditions were clearly disclosed before booking and are stated in the booking confirmation, those rate-specific conditions take precedence over the standard payment and cancellation terms above.
6.3 Refunds following a free cancellation
Where a standard-rate booking is cancelled within the applicable 0% cancellation period, accommodation amounts already paid will be refunded to the original payment method where reasonably practicable.
Statutory charges collected for a stay that does not take place will be dealt with in accordance with the applicable law and collection rules.
6.4 Early departure
If a guest voluntarily leaves after check-in before the confirmed departure date, unused nights and services are not refundable unless Fanal expressly agrees otherwise or a refund is required under applicable law.
7. No 14-Day Cooling-Off Right for Dated Accommodation
Accommodation booked for a specific date or period is not subject to the general 14-day statutory withdrawal right that applies to certain other distance contracts. Your cancellation rights are therefore those stated in the applicable booking conditions and these Terms, without prejudice to any mandatory legal remedies that may apply if the contracted accommodation service is not properly provided.
8. Amendments Requested by the Guest
Requests to change dates, accommodation, duration, guest numbers or other material booking details are subject to availability and must be accepted by Fanal before they take effect.
A change may result in a different price and may also affect the applicable payment or cancellation conditions. If the requested change cannot be accommodated, the original booking remains in force unless it is cancelled in accordance with the cancellation policy applicable to the booked accommodation category and rate.
Where a booking was made through a third-party platform or travel partner, amendments may need to be processed through that booking channel.
9. Changes or Cancellation by Fanal
We make every reasonable effort to provide the accommodation confirmed. Occasionally, circumstances may make the booked unit unavailable, including urgent maintenance, safety issues, significant damage, operational failure or events outside our reasonable control.
Where reasonably possible, we may offer alternative accommodation of equivalent or superior overall standard and suitable capacity without additional accommodation charge. We will take account of material features of the original booking when selecting an alternative.
If we cannot provide the contracted accommodation and no suitable alternative can reasonably be offered, we will refund the amount paid for the accommodation or affected part of the stay as required by applicable law. Nothing in this clause limits any mandatory consumer remedy.
10. Check-In, Check-Out, Early Check-In and Late Check-Out
Standard check-in is from 15:00 on the arrival date. Standard check-out is by 10:00 on the departure date. Early check-in and late check-out may be requested or prebooked as optional services, either when making the reservation or before the stay. Both services are strictly subject to availability and confirmation by Fanal Holiday Homes.
A request or prebooking does not constitute confirmation until Fanal Holiday Homes has expressly approved the requested service and time. Availability may depend on occupancy, housekeeping schedules, maintenance requirements and incoming or departing reservations. Early check-in, particularly for morning arrival times, can only be confirmed where the accommodation can be prepared and released safely in time.
Where an early check-in is approved, the following standard charges apply unless a different charge is expressly agreed in writing:
• From 13:00 and before the standard 15:00 check-in time: EUR 25.
• From 11:00 and before 13:00: EUR 50.
• From 08:00 and before 11:00: 80% of the applicable nightly accommodation rate.
• Before 08:00: an additional night of accommodation must be booked and confirmed, subject to availability.
Where a late check-out is approved, the following standard charges apply unless a different charge is expressly agreed in writing:
• After 10:00 and up to 12:00: EUR 25.
• After 12:00 and up to 14:00: EUR 50.
• After 14:00 and up to 20:00: 80% of the applicable nightly accommodation rate.
20:00 is the latest permitted late check-out time under this service. Occupancy beyond 20:00 requires an additional night of accommodation and is only possible if separately booked and confirmed by Fanal Holiday Homes, subject to availability.
Where an early check-in or late check-out has been confirmed and prepaid but Fanal Holiday Homes is subsequently unable to provide the confirmed service, the charge paid for that optional service will be refunded.
An approved early check-in or late check-out relates only to access to the accommodation and does not extend the operating hours of swimming pools, communal areas, reception or any other facility or service.
11. Occupancy and Registered Guests
The maximum occupancy of each accommodation is the occupancy stated in the property description or booking confirmation. It must not be exceeded without Fanal's prior written approval.
Only guests registered or included in the reservation may stay overnight. The Lead Guest must notify us of any change in party composition before or during the stay where this affects occupancy, charges, registration or safety requirements.
Fanal may refuse additional occupants where the accommodation would exceed its permitted or advertised capacity.
12. Children and Supervision
Parents, guardians and accompanying adults remain responsible for the supervision and safety of children in their party at all times, including around swimming pools, stairs, balconies, terraces, roads and other areas where additional care is required.
Children must not be left unsupervised in or around swimming pools. Any safety instructions or signs displayed at the property must be followed.
13. Swimming Pools and Communal Areas
Where a property includes access to a communal swimming pool, standard pool opening hours are 08:00 to 20:00 unless a different time is displayed at the property.
Pools close after 20:00 to allow maintenance, water treatment, cleaning and other operational work and to support a safe and peaceful environment for guests and neighbouring properties.
Only registered Fanal guests entitled to use the relevant pool may access communal pool areas. Visitors are not permitted to use the communal pools.
Guests must comply with pool rules and safety signage, supervise children at all times, avoid behaviour that
endangers others, and must not interfere with pool pumps, filters, chemical dosing systems, plant rooms or other maintenance equipment.
For safety, maintenance or water-quality reasons, a pool or part of a communal area may occasionally need to be temporarily closed. We will aim to minimise disruption and restore access as soon as reasonably practicable.
14. Air-Conditioning, Electricity and Utilities
Where bedroom air-conditioning is coin-operated, the current reference is approximately EUR 1 for around three hours of operation of one bedroom air-conditioning unit. If more than one unit is operated simultaneously, the available credit will be consumed correspondingly faster. The stated operating time is an approximate reference because actual consumption can vary according to the units used and operating conditions.
Guests must use electrical, water, heating, cooling and other installations responsibly and must not interfere with electrical panels, meters, pumps, boilers, water systems or maintenance equipment.
Temporary interruption of electricity, water, internet or telecommunications may occasionally occur due to utility providers, network faults, emergency works or other circumstances outside our reasonable control.
Fanal will take reasonable steps to report and address issues within its control, but uninterrupted third-party utility or network service cannot be guaranteed.
15. Wi-Fi and Internet Access
Wi-Fi is provided as a guest amenity at our accommodation. Performance may vary according to property
construction, device compatibility, local network conditions and third-party internet service availability.
Guests must not use the internet service for unlawful activity, infringement of third-party rights, unauthorised access
to systems or any activity likely to disrupt or compromise the network.
16. Linen, Towels and Mid-Stay Service
Fanal provides one standard set of bed linen and towels per guest for each 7-day period, subject to the facilities and arrangements applicable to the booked property.
For stays longer than 7 nights, a scheduled mid-stay service is provided in line with the length of stay. The service may include replacement of towels and linen and bathroom servicing according to the applicable property arrangements.
Where pool towels are provided, they remain the property of Fanal. A replacement charge of EUR 25 may be applied for each pool towel that is missing or not returned at the end of the stay.
Additional linen, towel changes or cleaning requested beyond the included service may be available for an additional charge.
17. Self-Catering Supplies, Waste and Laundry
Our accommodation is provided on a self-catering basis. Starter supplies are intended to assist guests on arrival and are not an unlimited hotel-style replenishment service.
Unless a property or booking states otherwise, the initial supply normally includes one toilet roll per bathroom and an initial quantity of rubbish and organic-waste bags. Guests are responsible for purchasing further consumables required during the stay.
Guests are responsible for disposing of household waste in accordance with the local collection system and
instructions provided by Fanal, including taking waste to the designated collection point at the required time.
Where guest laundry facilities are available, they may be coin-operated. Laundry detergent is not supplied unless specifically stated.
18. Cleaning and Condition of the Accommodation
The accommodation should be left in a reasonably tidy condition. Standard end-of-stay cleaning does not include extraordinary cleaning arising from misuse, excessive dirt, stains, unauthorised parties, excessive rubbish or other conditions materially beyond normal holiday use.
Where additional cleaning is reasonably required because of the way the accommodation has been used, Fanal may seek reimbursement of the reasonable additional cleaning cost, subject to evidence and applicable law.
Guests must allow reasonable access for any scheduled mid-stay service included with the booking. If access is repeatedly refused, we may be unable to provide the service later at the same time or on the same day.
19. Damage, Breakages and Missing Items
Guests must take reasonable care of the accommodation, furniture, equipment, keys, linens, pool equipment and other property made available to them.
The Lead Guest is responsible, to the extent permitted by law, for damage or loss caused by the deliberate act, negligence or misuse of a member of the party or an authorised visitor, excluding normal wear and tear.
Damage, breakages or defects should be reported promptly so that we can take appropriate action. Where
reimbursement is due, we may seek the reasonable cost of repair, replacement or additional work and will take account of age, condition and fair wear and tear.
Guests must not move, dismantle, modify or interfere with pool, electrical, plumbing, internet, safety or maintenance
equipment.
20. Parties, Noise, Conduct and Neighbours
Our accommodation is intended for holiday residential use by the booked guests. Parties, events and gatherings likely to cause disturbance are not permitted unless expressly agreed by Fanal in writing.
Guests must behave considerately, respect neighbours and other guests, comply with any quiet-hour instructions communicated at the property or in the guest guidebook, and avoid excessive noise, threatening conduct, illegal activity or behaviour likely to cause nuisance, damage or danger.
Serious or repeated breach of these requirements may result in reasonable intervention by Fanal. Where a breach is sufficiently serious and where permitted by law, we may require the person responsible, or the party as a whole, to leave the property. Any decision to terminate a stay will be proportionate to the circumstances and does not affect mandatory legal rights.
21. Barbecues, Open Flames and Fire Safety
Barbecues, open fires and similar cooking or heating devices are not permitted unless the booked property expressly provides a designated facility or Fanal has given prior written approval.
Guests must comply with fire-safety instructions, must not obstruct fire exits or safety equipment, and must not tamper with alarms, extinguishers or other safety devices.
22. Pets and Assistance Animals
Pets are not permitted at our apartment complexes. Certain farmhouse or villa properties may accept pets only where this is expressly indicated or approved by Fanal in advance and subject to any stated conditions or charges.
A pet must never be brought to a property on the assumption that it will be accepted. This clause does not limit any rights that apply to recognised assistance animals under applicable law.
23. Access by Fanal Staff and Contractors
We respect guest privacy. However, Fanal staff or authorised contractors may need to enter accommodation for scheduled services, requested maintenance, urgent repairs, safety checks, investigation of a reported problem, protection of the property or response to an emergency.
Reasonable notice will be given where practicable. In an emergency or where immediate action is reasonably
necessary to protect persons or property, access may be required without prior notice.
24. Property Descriptions, Photographs and Facilities
We take reasonable care to ensure that descriptions and photographs accurately represent the accommodation.
Furnishings, decor, equipment or landscaping may be replaced or changed from time to time, and minor variations that do not materially alter the nature or standard of the booked accommodation may occur.
If a material facility unexpectedly becomes unavailable, guests should notify us promptly. We will assess the
circumstances and, where reasonably possible, provide a remedy appropriate to the impact of the issue and
applicable law.
25. Maintenance and Reporting Problems During the Stay
Holiday accommodation occasionally requires maintenance. Guests should report faults, damage, cleanliness
concerns or service problems as soon as they become aware of them so that we have a reasonable opportunity to investigate and, where possible, correct the issue during the stay.
Urgent issues should be reported using the contact method provided in the booking information or guest guidebook. Non-urgent matters should be reported to the office or reservations team.
Reporting an issue promptly does not remove any statutory rights; it enables us to assess the problem, verify relevant facts and provide an appropriate solution where possible.
26. Guest Property and Valuables
Guests remain responsible for their personal possessions. Reasonable care should be taken to secure doors and windows and to use any safe provided at the accommodation for suitable valuables.
Fanal is not responsible for loss, theft or damage to personal property except to the extent that the loss results from a breach of duty by Fanal for which liability cannot lawfully be excluded or limited.
27. Circumstances Beyond Our Reasonable Control
Events outside our reasonable control may include severe weather, natural events, widespread utility or
telecommunications failures, government or authority action, civil emergency, transport disruption, fire, flood, epidemic or similar events that could not reasonably have been prevented by Fanal.
If such an event affects a stay, we will take reasonable steps to minimise disruption and will communicate material changes where practicable. If the contracted accommodation cannot be provided, any alternative, refund or other remedy will be determined in accordance with the circumstances and applicable mandatory law.
28. Our Responsibility
Fanal is responsible for providing contracted accommodation services with the standard of care required by
applicable law. Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability that cannot legally be excluded for death or personal injury caused by negligence, fraud or other non-excludable liability.
To the extent permitted by law, Fanal is not responsible for loss or damage caused by a guest's own act or omission, a breach of these Terms, an independent third party for whom Fanal is not legally responsible, or an event outside our reasonable control.
Guests are expected to take reasonable steps to minimise avoidable loss and to notify us promptly of problems so that corrective action can be considered.
29. Travel Insurance
We recommend that guests arrange appropriate travel insurance covering cancellation, travel disruption, medical circumstances, personal belongings and other risks relevant to their trip. A guest's inability to travel does not automatically alter the payment or cancellation conditions applicable to the reservation.
30. Privacy and Personal Data
Personal data is processed in accordance with the Fanal Holiday Homes Privacy Policy. The Privacy Policy explains the information we collect, the purposes and legal bases for processing, sharing with service providers and booking partners, retention, CCTV, international transfers and data-protection rights.

31. Website, Booking-System and Obvious Errors
We take reasonable care with prices, availability and property information. If an obvious technical, typographical or pricing error occurs, we may contact the guest promptly to correct it. We will not rely on this clause to make an arbitrary change to a valid confirmed price.
Where an obvious error is identified before the stay and cannot reasonably be honoured, the guest will be given an appropriate option, which may include accepting the corrected terms or cancelling for a refund of amounts paid in relation to the affected booking, subject to applicable law.
32. Complaints
If you are dissatisfied with any aspect of the accommodation or our service, please report the matter promptly during the stay wherever possible. This gives us the opportunity to inspect the issue and attempt to resolve it.
Formal complaints may be sent to reservations@fanalholidayhomes.com or to our postal address. Please include the booking reference, property, dates of stay and sufficient details of the issue.
Nothing in this complaints procedure prevents a consumer from using any complaint, consumer-protection,
alternative dispute-resolution or court procedure available under applicable law.
33. Governing Law and Consumer Rights
These Terms are governed by the laws of Malta. This choice of law does not deprive a consumer of any mandatory protection that applies under the law of the consumer's habitual residence where such protection cannot legally be excluded by agreement.
Any dispute will be dealt with by the courts or other competent bodies having jurisdiction under applicable law.
Nothing in these Terms creates an exclusive jurisdiction clause that would unlawfully restrict a consumer's rights.
34. Severability and No Waiver
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed only to the extent necessary, and the remaining provisions will continue in effect.
A delay or failure by Fanal to enforce a provision on one occasion does not mean that the provision is waived for the future.
35. Changes to These Terms
We may update these Terms from time to time to reflect changes in law, business operations, services or guest policies. The version applicable to a booking is normally the version provided or made available when the booking is concluded, except where a later change is required by law or is expressly agreed with the guest.
